2. Changes to our website and terms
We may update or change our website and these terms from time to time. We take reasonable steps to keep content accurate but are under no obligation to keep it up to date. The version of these terms in force is the one published on our website when you use it.
3. Accessing our website
Our website is provided on an “as is” and “as available” basis. We do not guarantee that it, or its content, will always be available, uninterrupted or error-free, and we may suspend, withdraw or restrict access to all or part of it without notice. You are responsible for making sure anyone who accesses our website through your connection is aware of these terms and complies with them.
4. Your account
If you create an account, you are responsible for keeping your login details confidential and for activity that takes place under your account. Tell us promptly at [email protected] if you think your account has been accessed without your permission. We may suspend or disable an account if we reasonably believe these terms have been breached.
5. Intellectual property
All intellectual property rights in our website and its content (including design, text, graphics, logos and software) are owned by or licensed to Ticket Monkey. You may view, and print or download extracts for your own personal, non-commercial use, provided you do not modify them and you acknowledge Ticket Monkey as the source. You must not otherwise copy, reproduce, distribute or commercially exploit any part of our website without our prior written permission. “Ticket Monkey” and our logos are trademarks of Ticket Monkey Ltd and may not be used without our consent.
6. Event and organiser content
Event information — including names, dates, times, venues, prices, availability, descriptions and images — is provided to us by event organisers. The organiser is responsible for the accuracy and completeness of that content and for the event itself. We are not liable for errors or omissions in organiser-provided event information, although we will help where we reasonably can.
7. Acceptable use
When using our website you must not:
- use bots, scrapers or other automated means to access, copy or purchase tickets without our consent;
- buy or attempt to buy tickets in excess of any stated limit, or to resell them in breach of the applicable Purchase Policy;
- interfere with, overload or disrupt the website or any systems or networks connected to it;
- upload or transmit any harmful code, virus or malware;
- infringe the intellectual property or other rights of anyone else; or
- use the website for any fraudulent, unlawful or harmful purpose.
We may suspend access, block transactions, cancel orders or report conduct to the authorities if we reasonably believe you are in breach.
8. Third-party links
Our website may link to third-party sites and resources for your information only. We do not control them and are not responsible for their content or your use of them.
9. Our liability to you
Nothing in these terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for any of your statutory rights as a consumer that cannot be excluded.
Subject to that, and to the maximum extent permitted by law, we are not liable for:
- loss of profit, revenue, business, goodwill or anticipated savings;
- any indirect or consequential loss;
- the accuracy of event information provided by organisers, or the quality, safety, suitability or performance of any event; or
- loss or damage caused by viruses or other harmful material, or by a denial-of-service attack, that affects your equipment through your use of our website.
If you buy tickets, your rights and our responsibilities are set out in the applicable Customer Purchase Policy, which takes precedence over this section for purchases.
10. Viruses and security
We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for using your own up-to-date security software. You must not misuse our website by knowingly introducing viruses or other malicious material, or by attempting to gain unauthorised access to it.
11. Governing law and jurisdiction
These terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction. Nothing in these terms affects your statutory consumer rights.
